Welcome to SideGigs. By accessing or using our platform, you agree to be bound by these Terms of Service. Please read them carefully. If you do not agree, do not use SideGigs.
1. About SideGigs
SideGigs is an online marketplace that connects people who offer local services ("Providers") with people who want to hire them ("Buyers"). SideGigs is not a party to any agreement between Buyers and Providers — we provide the platform that facilitates these connections.
2. User Accounts
Eligibility
You must be at least 18 years old to use SideGigs. By creating an account, you represent that you meet this requirement.
Account Responsibility
You are responsible for maintaining the security of your account credentials. You agree not to share your password or allow others to access your account. You are responsible for all activity that occurs under your account.
Accurate Information
You agree to provide accurate, current, and complete information when creating your account and to keep this information up to date. SideGigs reserves the right to suspend or terminate accounts with false or misleading information.
3. Booking Agreements
How Bookings Work
Buyers submit booking requests to Providers. A booking is confirmed only when the Provider accepts the request. Until the Provider accepts, no agreement exists between Buyer and Provider.
Provider Responsibilities
Providers agree to accurately describe the services they offer, fulfill confirmed bookings in a professional manner, and communicate promptly with Buyers. Providers represent that they have all necessary skills, licenses, and permissions to perform the services listed.
Buyer Responsibilities
Buyers agree to provide accurate information when requesting services, be available and prepared at the agreed time and location, and treat Providers with respect.
4. Payments and Fees
Platform Fee
SideGigs charges a 10% commission on each completed transaction. This fee is automatically deducted from the total booking amount. Providers receive 90% of the agreed price.
Payment Processing
Payments are processed securely through Stripe. By making a payment, you agree to Stripe's Terms of Service. SideGigs does not store your payment card information.
Taxes
You are solely responsible for determining and paying any applicable taxes related to transactions you conduct through SideGigs. SideGigs does not collect or remit taxes on your behalf.
5. Cancellation Policy
Cancellation by Buyer
Buyers may cancel a booking before the Provider has confirmed it at no charge. Once a booking is confirmed and payment is processed, cancellation requests must be handled directly between Buyer and Provider. SideGigs may facilitate refund requests but does not guarantee refunds for confirmed and paid bookings.
Cancellation by Provider
Providers may decline a booking request before accepting it. Providers who frequently cancel confirmed bookings may have their listings suspended or removed from the platform.
Disputes
In the event of a dispute, contact us at hello@sidegigs.to. We will work in good faith to help resolve disputes, but we are not obligated to arbitrate or adjudicate disputes between users.
6. Prohibited Conduct
You agree not to use SideGigs to:
- Offer or request illegal services of any kind
- Harass, threaten, or deceive other users
- Post false, misleading, or fraudulent listings
- Conduct transactions outside the platform to avoid fees
- Scrape, copy, or redistribute platform data without permission
- Impersonate another person or entity
- Violate any applicable law or regulation
SideGigs reserves the right to remove listings, suspend, or terminate accounts that violate these rules without notice.
7. Content Ownership
Your Content
You retain ownership of any content you post on SideGigs, including listing descriptions, photos, and profile information. By posting content, you grant SideGigs a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute that content for the purpose of operating and promoting the platform.
Our Content
All other content on SideGigs — including the platform design, logos, software, and written content — is owned by SideGigs and may not be copied, reproduced, or used without written permission.
8. Limitation of Liability
SideGigs provides the platform "as is" and makes no warranty that it will be uninterrupted, error-free, or free of harmful components. To the maximum extent permitted by law:
- SideGigs is not liable for the quality, safety, legality, or delivery of any service listed on the platform
- SideGigs is not liable for any indirect, incidental, or consequential damages arising from use of the platform
- Our total liability to you for any claim shall not exceed the fees you paid to SideGigs in the 12 months prior to the claim
SideGigs is a marketplace facilitator — we connect Buyers and Providers, but we do not perform or guarantee any services. You use the platform at your own risk.
9. Indemnification
You agree to defend, indemnify, and hold harmless SideGigs and its affiliates from any claims, losses, or expenses (including reasonable legal fees) arising from your use of the platform, your content, or your violation of these Terms.
10. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes by posting a notice on the platform or sending an email to your registered address. Your continued use of SideGigs after changes are posted constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction in the United States.
